18 Legal? - 06-23-2010, 12:33 AM

Hey folks first time here so I'll do my intro in a sec but had a question. I understand from just researching this site and other sites that 18 would be of legal age; however does it matter if this person is a senior in highschool? Does that affect anything? I plan to have my consent form and take a picture of ID but I guess I'm a little concerned about her being 18 but still in school. I rather wait for her to finish school than be sorry. Anyone have any input here? thnx in advance

Are you talking about for taking risque' pictures?

Technically, yes, 18 is legal age. You need to pay particular attention to 2257 if you are shooting more than artistic nudes... or even for that, too by some interpretations of the law.

BUT

The other thing to watch out for is there is usually a "student code of conduct" that they have signed... and you don't want to get on the bad side of a school district.

If you aren't talking about risque' pics... then the only reason I can think of to ask this question is about a model release... at 18 they can sign any legal document, including a model release.

thnx for the response Brad. Actually she wanted traditional outdoor pics...nothing risque...but then again not sure how to define risque but I certainly wasn't going to have her get into any to sexy in terms of outfit or provocative posing. I just didn't know with her technically still being in high school. As a beginner I'm just trying to be extremely careful as it scares me to read these horror stories with someone not being of legal age or consent.

Even though she is of the age of majority, I would try to have someone else (like her parent?) on a shoot. This can help avoid any appearance of impropriety on your part.

Is she paying you or her parents? If it's her parents I would definitely have them sign a contract as well.

Actually it was going to be a TFP. Thnx for all the feedback...I didn't realize that her still being in school would potentially open myself up to issues but i'm glad i'm asking.

I think people were more talking about nude modeling in regards to getting in trouble with the school. If it is "senior" type pictures, she shouldn't get in any trouble, but I would probably just talk to the parents too and have them sign the contract to be on the safe side.

For example, I was looking to do some engagement type pics and I like very kissy kissy pictures that show a lot of emotion. I had a girl in highschool apply that was adorable with her and her boyfriend. She was of legal age, but I still didn't want her dad coming after me. Also, call me old fashioned, but I just feel weird about having a high school kid make out in front of me ;)

Yeah these wouldn't be senior pics. She just wants a photoshoot but I didn't want to do anything too crazy. I think i'll stick with asking her to have her parent present or wait till she's out of school to be safe. Oh and I don't think i could've done that shoot either...i would've felt kinda weird myself.

I wouldn't think in school or out of school would be a question unless you were a teacher or administrator at the school, and then only if they were risque shots. 18 is 18, a code of conduct for a student would only effect student, or person involved with the school. As long as she was of legal age there should be no problem, I do like the idea of having the party that is paying sign a contract.
