I'm going to my best friends house in Kansas, in July to pick up Joyce. She has a few friends that want pics. I'm not looking to market there, just do some shoot and burn sessions. Do I have to get another sales tax permit for Kansas???

I'm going to answer even though I'm not a CPA or attorney: nope. If your business is based in one state, and you work and provide services to someone in a different state, you don't charge Texas state sales tax. Although probably more complicated, that's why anyone outside of New York state can order camera gear from B&H and not be charged sales tax. Go to the brick-and-mortar store in NYC and you're gonna pay the tax.

If its not on a reg. basis and you dont have a physical presence in the state. But you should run it by the comptroller to double check. :o)

My father lives in a tri state area and he usually tries to makes things easy and not always legal, he pays taxes in three different states. FWIW...

You may indeed be required to pay sales tax for the state and locality where the sessions take place. Although every state is different, here in NY if I do business in NJ then I am required to pay taxes to NJ on that income, taxed at the rate of the NJ locale where it took place. Thankfully NY and NJ have a reciprocity agreement and once you get your paperwork you just have to note what you did on your sales tax form and NY shifts the amount required to NJ for you. But, without that agreement you would have to send NJ a separate check for the collected taxes.

Up here we even break it down into counties and cities and other stupid little deals that get their 1/4 or 1 percent. So glad my accountant has been with me since day one...

If you have a CPA or know one I would give them a call so you get the best info for your area.

I have a CPA, I will give him a call! I was just thinking about his last night, so I thought I post to see if there was a simple answer! I should have known, taxes are never simple!

I would think you would treat it like a wedding photographer would. Charge your normal sales tax. Probably would be the best person to answer this would be a wedding photog, but they do destination weddings so they would know right? I'd like to know the answer to this myself :)

At one time there was an effort by MN, I believe, to collect income taxes from truck drivers that passed thru there state while delivering goods to any other state. Can you imagine how difficult my taxes would have been if they had succeeded!!

Will you be burning the CD's while there in KS or will they be shipped back later? this could make a difference.

I was thinking I would burn them there, but if it makes it less complicated, tax wise, I will burn them here and ship them.

My CPA is on vacation (duh) so no answer yet.

There's always the Gulf Coast fisherman method; claim ignorance of any taxes on cash payments.
