Legal Question - 04-27-2011, 03:28 PM

I'm not sure if this is the right place or not but I have a situation that I'm not sure of the consiquences. I took some boudoir photos of a friend of mine about a year ago (not revealing at all) for FREE and it was understood that I would use them as portfolio work since they were for free and she was fine with that, meaning they would be on my Facebook and website. Now there has been a little falling out where we don't really speak anymore and she messaged me today asking if I could remove them from my facebook because her husband's cousin is on my facebook and I guess she's embarrassed. However he's been a friend on my facebook for about a year around the time when I put her photo's on there so he's already seen them I'm sure. So my question is do I have to take them down since she's asked me to or do I have the right to keep them up? I did not have her sign a model release =/ it didn't even cross my mind at the time since we were friends. Thanks in advance!

This one seems simple. No model release. I would take them down.

Yep. Take them down. Not just because you didn't get a model release, but also because it is the right thing to do. No reason to generate bad karma over one shoot.

Go create newer and better stuff.

Darn, that really sucks...I took time outta my schedule to take the photos and edit them and now they go to waste :( I guess that's a lesson learned, everybody even friends need to sign a model release.

I looked on my wall and didn't see my "lawyer plaque", so I will just say from a professional viewpoint, it is the right thing to do.

I am not sure why you even have to ask, since you have had a falling out.

Lol I think its because I'm like a hoarder of all of my photo's, like I don't like to get rid of any of them, its weird. I still have up my very first images that are HORRIBLE because I can't stand to take them down. They are all a part of me and I like to show them all, like they are my kids, lol. Weird, I know.

Steven, I agree that the right thing to do is to take them off FB. However using them as reference for processes that worked or didnt work in your shooting makes them worthwhile to you even if no one else sees them. No image is wasted if you learn something from it.

I "sell lawyers" if you'd like a professional answer.

PM me for details......
