If a public educational group (e.g., a high school) in the state of Texas hires a photographer at 'x' rate/hour, is that educational group responsible for paying taxes on the total amount?

i've found the state to be helpful. have you tried calling them? i would trust them more than any advice i would receive on here. here are some tips on when to call. 1-800-252-5555 you can also email them.

generally, when someone is exempt from sales tax, you are to collect a form from them in which they claim they are exempt and sign. keep this form, as it is the piece of CYA you receive.

They would have to pay sales tax, unless the SCHOOL is paying for the work. In otherwords, the check for your payment has to be coming from XXX Indepent School District.

If the payment is coming from an individual or other means, like say a Booster Club etc. and the Club or Organization is NOT 501 (c)3 - Exempt then they are responsible for paying tax.

Just a little note...You aren't CHARGING anyone tax. You are collecting it on a sale as required by law and remitting it to the State. You don't charge the client, the State of Texas does and you are merely the agent.
