Stanford University has contacted me and wants to buy some of my pics, one this weekend, for use on a poster. My pics are with an agency, and yes, I have tried to contact the agency, but it's the weekend, so not sure I will get a response. Anyway, they are laying out the poster this weekend and want to buy the one image now. Does anyone here who is with an agency know if I can sell to them directly since they are not a magazine but an educational establishment? I'm just not sure if that is a violation or not. Also, I think if they buy directly through the agency, which they will do, they might have to go through the approval process so they wouldnt be able to get the pic until probably Monday or Tuesday. The last note from them said that if I could send them the high res so they can put it together, they will deal with the agency after that for the proceeds. It's mostly a time issue. Thanks in advance in anyone happens to know!

I don't know, but advice is to send them the image and work it out with the agency when you can get them. "It's easier to ask for forgiveness, than to get permission".

It is a reasonable request from the Edu. and as long as they know you are represented and are willing to deal with the agency I think you are acting in good faith, and representing yourself in the agencies absence......

Ok, cool, cuz that's what they are wanting to do. Here is the last message from Stanford:

Absolutely understood. I am the one in charge of paying the bills for these
projects in our Center, so you can assure your person that the fee will be
paid Monday. (Stanford, like all universities takes a couple of weeks to
mail checks out.)

Hey Leslie,

It depends on your agency contract. The two agencies that I have representing me are both non-exclusive - that is that they can market the images and so can I as long as another agency does't market the images as well. That means, they have a copy of my digital images but I have a copy as well. Double the marketing power!.

What I'd suggest is finding your agency contract and seeing what it says. If it is a non-exclusive representation, then I'd sell away.

Cool! I will try and find it and see! I know I get to keep the copyright, but I need to track donw my contract and see if it is non-exclusive. I know some allow you to sell things locally and for ngo's and such. Anyway, thanks so much Russell and Tom!! It wouldnt be a big deal if they didnt need it asap.
