1) I use a 3rd party printer which is out of state. I don't need to worry about taxes on prints, do I?

2) I always see photographers at events taking pictures to sell on their website. I wanna do that. Do I need a special permit, permission, etc. What are the rules on that?

Quick answers:

1. Yes, you do need to worry about taxes. You are the one selling to the consumer, therefore it is up to you to collect the tax on your sale. The printer may be able to not charge you tax (depending on your status as a business, out of state etc.), but you are the seller to the consumer. Best advice, get a CPA.

2. You most likely need to contact the individual event organizer for permission or they can likely get you pointed in the right direction. They or the city/whatever may need to see your business license, insurance, etc. and the city may need to issue a permit for the event. Be prepared to present all the require business paperwork, especially at events. A hotel I went to shoot a wedding at required me to give them with a copy of my liability insurance or not shoot there. It happens when you will least expect it.

Thank you. for 1) Well, that's gonna be a real pain in the butt! How do you guys do it when you use Pictage, etc?
2) That's what I figured. One event I went to the photographer asked everybody he photographed "can I put your picture online?" and then gave them a card with the address to access their pics. Other places they didn't ask individual people, just put the cards out. I'm not talking about a wedding, just a general public event. How do you guys usually do it?

On #1 it can vary depending how things are set up.

For instance Exposure Manager: They way they have pro-labs set up is that EM is selling the product to the customer. Since EM is not in Texas, they don't charge sales tax to Texas clients. EM is buying the images from you, again since they are out-of-state = no sales tax.

see, that's what i thought. my printer's agreemant labels me as the "licensee" and
