I've looked through several of the "Release Form" threads that we have in this forum and don't really see anything that addresses the issue that I'm facing.

One of my customer's wants to use a digital image that I had taken of them during a recent portrait session and send it off to a printer to have some Christmas cards made. I'm not going to go into a long story, but I know these people very well and don't have a problem with giving them a digital copy of the image that they are requesting. The problem lies with whomever they have chosen to do the printing. They are requesting some kind of release form which grants them permission to print the image. Does anyone know what such a form would look like? Does anyone have an example of one that I could look at and modify?

yeah, this happens if someone tries to print at there local walgreens, wal-mart, etc. you basically just need to give them something saying they have permission to print it. doesn't have to be fancy. i think something to the effect of , you the photographer give permission to so and so blah blah blah, etc. etc.

i have a little form letter that says "________ or anyone working on their behalf has my permission to reprint this image for personal, non-commercial use."

i also thank the establishment for their concern for porfessional copyright.

Brad has a very good one. Mine is a little less lawyerly and still works in most situations. But most of my clients a portrait clients. I have one more like Brad's for commercial work.

I was thinking along the lines of what Brad has done. It's more "legalese" but in today's world, that's what we are being forced to do. Make your own form up but remember o include "For valuable consideration received" meaning the person/s whom you're transferring rights to has given something for these rights. Also be sure and convey "non-exclusive rights" meaning you still have rights to use, sell or do whatever with the photos as they are still yours and include a time frame for which you are conveying these rights. It could be for one year or it could be ten years. Just be sure and include this because if you don't, they have rights forever. You might also state that the rights are conveyed to them for a specific purpose such as "mass or bulk printing of personal Christmas cards". The bottom line is, the more "i's" you dot and "t's" you cross, the less likely there will be any problems for you and them down the road.

Also if you have imbedded data in the file stating date/ time/ file name/etc you can also include that information so that the speciic photo file in question is the one being reprinted.

I take a signed and dated copy of the license to use the images I give the model and scan it to the CD containing the images. That way they can't loose it as easily. They also get the hard copy.
