Need Advice/Help - UPDATE - 01-16-2007, 08:26 AM


So last week one of my May brides called me up to get permission to use one of her engagement pictures in her office newsletter (she works for JCPenny) and I of course said sure that would not be a problem, because it's for the Feb. newsletter - v-day, love and all that junk -

so i got an email from her this morning

"The internal magazine want to use me as the cover, which I believe goes outside what the pictures were initially intended for... I guess I didn't understand what they were talking about. It goes along with a story about JCPenney's gift registry, and since I'm getting married, they wanted a registry participant to be featured. They are supposed to be calling you this morning about getting permission for using a photo/paying you for the usage. I am SO SORRY that I told you wrong, as I was confused."

So aside from of course telling them I want photo credit, if they ask how much I charge for usage, I am at a totally loss of what I should tell them.

I've used this in the past:

And it says that for a corporate magazine, less than 10,000 distribution, you should be looking for $500-11,000 ... with an average of $800.

Now, you may get wedding business out of this if there is a credit there.... so, figure out how much that is worth, too... but that gives you a place to start.

Just let them use it with photo credit. Don't scare them off with a bunch of money demands. Several local vendors are using my photos in full page ads in D Brides with my credits, and it's been nothing short of wonderful.

well I talked to her this morning and she said that while she doesn't have a big budget to pay for the usage, she would really love to give me something for it. So I was thinking I'd tell her $200 along with my photo credit. I told her really I just wanted the credit because like you said Cindy credit = exposure (hopefully bookings) and with it being on the front cover it's the first thing people will see. But she said that she has some extra in her budget for it and would really like to pay me.

Your wedding contract should say home use rights - non commerical.
The price for mag covers range from hundreds to thousands.
Its really what you set.
You might try giving the rights to publish for a large Gift Cert.
You might also hint that legal wilould cost JCP thousands and thousands.

UPDATE -

Ok so I have talked through email with the Senior Editor of Internal Communications and a usage fee has been decided and all of that groovy fabulous stuff (so everyone can say congrats....lol) My image will be being used for the cover of the internal employee magazine. So as you can imagine I am just really excited!

NOW i need to know if anyone has an image usage form that I could snag and re-word to make my own or any advice on what it should say??
