I did a few shots at Lone Star Park last year. Evidently, they liked some of them. They want to send me their 10th anniversary logo to incorporate into one of my images so they can turn it into a post card for sale in their Gift Shop.

I don't even know where to start. Contracts! Copyrights! What to charge!!!

I would mucho appreciate any thoughts or guidance. I never thought that something like this would happen.

License the image based on circulation (press run) and usage whether it be spot or major in scope. Maintain your copyright.

If your doing the art work you might make a one time charge additionally for that work.

One thing I've seen another photog do (that shoots for the big zoos and aquariums) is to request a byline on the bottom of the card that says something about Renowned Photographer Wes...and his studio. It makes you like like a big shot and most companies will allow a byline. I always look for more advertising...its freaking expensive. And you could always consider donating it - gasp - and go for the glory. Then your name would be in the newsletters and what-a-call-its too. Just an idea...

Absolutly, get your name on that card! Don't give up your copyright. Base the price on the amount of cards they expect to print(which equals sell). Limit licensing the time, one year. Don't do an exclusive, someone else might want that to use that image too. You might explore a fee based on sales of the card. The more money they make they more you make. If they sell only a few cards they pay less. You could event tier the amouts based on sales. But get at least a minimum for your time and trouble. Remember their are no real rules, only guide lines based on history, and everything is negotiable.

dmh has it down.
Limited Usage Agreement that only lets the client use that image for the one thing and not whatever they want. I normally include company newsletters and web usage just no other commercial usage except for what i have stated.

If they sell out of the images you should have something in there that states how much for a reprint. usually it's half the first fee.

the other way you can go is to charge so much a card but that gets to be a pain.

Business and Legal Forms for Photographers

The have it at HCE, or at least they did when I got my copy. It has boilerplate documents & contracts and descriptions on which is applicable in what situation.
