Exclamation Under Age Female Shoot - Questions!! - 03-09-2007, 11:19 PM


Greetings, all.

I have some questions. I have a young lady, 16, who is into the gothic/s&M scene (wow they start young) and she's interested in doing a shoot regarding that theme.

I need to know if this is allowable, the stipulations/rules/laws regarding this, and any permissions i'll need.

Also, how risque' can she get? She wants to do unbuttoned shirt w/o a bra, and maybe some implied nude.

I need to know everything I can before I give her a definite answer. Any help would be appreciated!!

You MUST have the consent of a guardian or parent...and have someone present to CYA, preferably the parent that gives you permission!

Get it all in writing. As far as how risque', it is up to her parent or guardian.

scary...have her parents/guardian there and alot of paperwork signed in quadruplicate and about 10 people in the room to cya.

Just don't do it. It isn't worth the risk. Consider what your maximum upside financially would be versus the possible liability. It's a business, treat it as such. JMHO.

As a parent I'd never shoot that or allow it of my child. I'd rather lose the business than shoot something like that.

Thanks for the feedback, but frankly, I can't tell her what she can and cannot do, she has her parents for that. What is this "cya" acronym? not familiar with it.

Now, on the UPSIDE, what type of shoot can we do, if any? I don't want to deny her, but I do want to keep it legal.

Here is a rule of thumb concerning the minors. If a district attourney can look at the photographs and believe that it will cause arrousal then you could possible have charges filed against you for indecency with a minor, even if her parents are present.

This law is in force in many of our counties throughout texas and a lot of the united states. While certain counties may have taken action to better define this most have chosen to leave it up to the D.A.

Me personally I don't trust a D.A. that much. They want convictions and it is easy to tug on a juries Heartstrings.

Be careful and keep it extremely professional, not daying you will cross the line but it is really close.

As a "pro" you should know what is allowable. But from the looks of things, he's looking for people to tell him what he can do (I guess). I suggest a gothic winter wear shoot. Nice thick garments covering everything....

Bottom line, not my humble opinion, but fact and law. She's 16. By law she's underage and a minor and any depiction, whether real or IMPLIED of a minor in a sexual situation or depicted in a sexual way can cost you time in the state prison whether her parents/guardians consent or not. In fact, if her parents do consent they can go to jail too for contributing to the deliquency of a minor. Seventeen is a gray area and you might get away with that if you pay the right lawyer enough money. The way the laws are written, a picture drawn with pencil that depicts a minor in a sexual situation is still considered child pornography. You can't even take an adult model and depict them as a minor in a sexual situation. Also, our federal government has jumped whole heartedly on the child porn bandwagon and has gone so far as to arrest and prosecute individuals under U.S. laws for sexual crimes commited in foreign countries even though the act was legal in the country it was commited.

Bottom line, I wouldn't touch this with your ten foot pole. This could turn very nasty.

I would cut out the S&M and just do gothic, but I wouldn't even do that with this girl...
