What do I need to "hire" a freelancer - 04-09-2007, 08:59 PM


I'm going to outsource some computer work to a freelancer, what forms if any do I need for that person to fill out?

They will be using their own computer at their house.

The only thing you must have is a W-9 form and perhaps some proof of eligibility to work in the US. There are some acid tests on the IRS web site that you can fill out to determine if the person is really a consultant or should be an employee.

You might consider adding a consulting agreement and non-disclosure form. If the work is proprietary in any way then I'd also add a non-compete to the non-disclosure. I hire consultants in my day job all the time. In fact I just hired one today and she will be filling out all the forms I mentioned here. Good luck.

thanks for the reply Scott. Don't I just need to file a 1099? When i say freelancer, I guess technically I'm using them as an independent contractor.
