Model Release and Faxing???

Just wondered if a model release is legit if it is faxed to the person, then signed and faxed back to me ...

While I can't speak for the legality, I know that I always keep the master copy. I typically have the signatures signed in blue ink so I know which one is the original after making copies.

If it's important you could have it signed in front of a notary at most banks. That would certainly help with ensuring the model is the one signing it and therefore make it a much stronger document.

Thanks. I was just told others haven't had a problem with the faxed copy, but if there is going to be money involved, they would have the original signed one mailed back to them as well.

In my other life I deal with legal signature stuff all the time. There is a law that can be interpreted that a fax signature is legal binding in the state of Texas.

Other then that....in all my time in court (I take customers who don't pay to court in my other life) I've never had a judge ask it this is an original signature.....they do whoever ask is this your signature.

I think that the point is proving that the signature is valid.

For a commercial release, I prefer to have an uninterested party witness and sign the document. Not as good as a notary, but better than just a signature. I also like to take a photo of the person holding their government issued ID to prove I did a reasonable job verifying their identity and age. Anyone under 20 years old (18 & 19) gets that done when they sign.

It can't hurt you...
