Hello,

I'm working to come up with a name for my photography business. Two of the names I really like are already used by other photographers: but very far away.

One photography studio is located in Canada, the other is a small independent wedding photographer in Georgia.

I'm going to be focusing on vintage portraits and children/family/glamour portrait photography, so they are not in the same style of photography.

Since there are no photography studios with the names I'm thinking of in my area, do I not worry about having the same name as someone else in another state/country? Or should I keep looking and try again for a name no one else has?

As long as the name has not been registered in your county as a "Doing Business As" or commonly referred to as "DBA", you should not have problem.

Actually, legally, you can be in the same county as another of the same name unless they have trademarked the name (or is it service marked? I always mix that up!). Might be a little confusing for your clients (or those you hope to attract as clients) but you could do it.

Our company name (R & J Photography) is also someone else's in Florida, as well as at least one other place. There is no one in Texas, last I checked, except for us though so we have stuck to it for the last 9+ years and built it up. You may find yourself getting a little creative with your website domain name if another company has your same name, but we haven't found that to be a problem either.
