I just did a photo shoot this week at a well known business location in my town (ATX...ya'll).

The model contacted the business ahead of time and got the approval to do the shoot.

After the shoot was done and we have decided to use the photographs, the Publisher of the magazine is requesting a release from the business to use the photos.

Do we legally need to get a release from the business. If they oppose, what can we do? I should of thought of this beforehand.

Yikes.

From the businesses perspective, this is free advertising for them, because they are well known, and if people see the cover, they should know the location.

Did you have anybody question you when you were doing the shoot? I would just find out from the model who gave you the approval and go to them and also give them a nice framed print of the shot that will be used for the cover of the magazine and just tell them that you need the paperwork for the magazine. They should have not qualms about signing the form since the shoot has already occured and since they will get some marketing out of the deal at no cost to them.

BTW congrats on the cover, let us know what it is after it hits the newstands.

The day of the shoot, the model went inside with me to get another go ahead. She said that she had already talked to them on the phone. So, is a verbal agreement good enough? I stopped by the place and gave them a 5x7 preview photo of the cover, along with a photo gift certificate from me, and also a release that the requested to fax back to me. I'll post a preview of the cover.
