Another concert shoot question - 08-12-2007, 12:32 PM

Similiar in the vein of laawaaris' quesiton posted previous, yet I don't want to step into his post with this.

I plan on going to a bluegrass fesival later in the year, and contacted them to see if my photo gear would be allowed. Received the reply that it would be fine .. then was asked if I would be interested in providing my photos back to them for their use in exchange for 2 free tickets to the event. If they gave me the best tickets, would save me 90 bucks. That is, if I even took anyone with me.

Now, I have no problem with giving them a few pictures for their use in flyers, and website/myspace promo .. howver I'm not willing to give them "all" my photos for $90. I've never been approched for anything like this before, so have no experience to fall back on. How would you reply to this? I shoot raw, so I suppose I would have to provide them with jpgs anyway, so there's conversion time unless I shot raw+jpg and lost storage space on my cards.

I can't see any concert goers really being that interested in buying any photos I might take, other than maybe of the more prominent acts. However, I can see the bands themselves being interested if I wind up with some good shots. It's going to be at the Pizza Hut park in Frisco, so it's not a small venue.

Thought I'd toss this up and get some feedback.

if i read between the lines correctly, it sounds to me like they are interested in a straight barter with you ... photos for them in exchange for free tickets for you

i would loop back with them and request that all photos used in flyers, promotion materials and on the website be given due credit to you ... one way to ensure this is to put your own logo on the photos, but i think they will not be happy with that

i would also shoot RAW+JPEG so you don't have to convert - simply supply the JPEG images to them ...

i would also email them back saying that if they want to have the photos retouched so they look professional there is a charge per photo ....

its really up to you but it sounds like it might be a good way to get exposure and get some free tickets at the same time

Yes, that's basically what he offered ..

Here is a question - we have a hard time getting enough good photo choices to put on the web site, etc. If you will provide us with a disk of all your photos and permission to use them at no charge for promotion (flyers, web site, etc.), I could give you a couple of free tickets to the festival. You will not be the only photographer, of course, but if you take good "ambiance" or "atmosphere" shots we could end up using them in connection with the festival.
Just wondered what others would counter back. I mean, I plan on going anyway and taking pictures just for my own enjoyment. Not interested in giving up my copyright, as I tend to catch a few good ones every now and again. :) Thinking of answering back that I'd be happy to supply them with some copies of some shots in exchange for tix, but I want to be recognized as the shooter. I think giving them co-rights to use in flyers/web for a year is fair, if there is such a thing as "co-rights".

Which Bluegrass Festival? I go to the Argyle festival every spring and have shot there. It'd be nice if you get to shoot that you get all access and maybe shoot behind the scenes.
Do you play an instrument too or just a fan?

Frisco Bluegrass Fest in Oct. I'm just a fan .. I used to pick at the mandolin but haven't touched it in about 4 years. Good lineup at it, think it will be a good concert.

i would absolutely state your demands ... tell them you want to be recognized as the shooter ... i would also request you be given a Press Pass so that you can go on the stage and go willy nilly everywhere to get the best shots ... i have had a Press Pass in the past at a concert/show and it makes a big difference (imagine shooting the crowd from the stage itself)

also, tell them your thoughts on the rights ... tell them you both have joint rights to use the photos for marketing, etc ... you are not releasing YOUR rights for promotional use to them, rather simply granting or sharing this right with them

i would also tell them that you are the only one who has rights to sell the photos ... if they find an outlet to sell the photos, they have to come to you later on and work out a deal ....

looking forward to seeing some of your photos on the forum

License them and price them accordingly for the uses they want them for. If you want to do it for trade for tickets, then do so. State it in your contract. You maintain your copyright unless you specially transfer it or take the job on as a "Work made for hire".

Well, I emailed them back and asked about press pass/all access, what they wanted, etc .. turns out they already have photogs that will be shooting the event. I think he was just trying to be nice to me and hoped he might get a shot or two that he could use. So, now I have to pay again :o :) I prefer it this way, as I don't have to worry about anything now.
