Yep, another pricing question - 08-24-2007, 03:34 PM

First post!

I've been lurking for about a month and I'm impressed with the amount of info and support here. Hopefully you can help me out.

I'm nowly semi-pro photographer so the whole getting paid thing takes a bit of getting used to. I was hired to shoot the Willie Nelson concert 2 weeks ago by the producer of the show. The agreement between her and I was the final product would be a cd of my shots that would be given to the sponsors of the show so that they could use pics on their respective websites. Everything went smashingly and she was ecstatic with the results.

I mailed out the cds on Monday and most of the sponsors got their copies today, along with a grant of usage rights for 1 year. I just got an email from the main sponsor trying to clarify the document. He wants unlimited usage rights and doesn't want to take the pics down in a year.

My question is, how much to charge for unlimited use? The producer doesn't care how I deal with him. We are talking about 150 shots and keep in mind that I have no contract with this guy, he has given me no money, and I have given him a year of usage for free.

I really could go either way. On one hand I don't mind giving him unlimited use because I already got paid for shooting, but on the other hand, it's a well known website with a lot of exposure and I don't mind getting paid a little more.

Here's a gallery of the shots: http://tardypizza.com/Images/Freedom%20Fest/

Total buyout would transfer copyright to him $10K
Unlimited usage for up to ten years $5K
Unlimited usage $1K per year
Just my 2 cents

I like Don's response and considering the subject of the photos, that might be a fair price. Of course, you've also learned never to do anything else without an upfront contract
BTW, you did a very good job on the images!!
something I learned the hard way...NEVER give away your rights....no matter who it is
I'd also be curious to know if you will get some type of photo credit on the sites....not necessarily a watermark, but something that credits you as the photographer

Thanks for the replies and especially the compliment. That was just the bit of info I was looking for to make sure I didn't underprice myself.

And as far as giving away my rights, I sent a very detailed grant of usage rights document along with each cd, so I hope I'm covered there. The agreement I had with the producer that paid me was that each event sponsor would get photos to use on their websites, so I fulfilled my obligation on that end, but I also protected my work by limiting the usage rights to 1 year.

And as far as credit for the photos go, if I get paid I don't really care whether they give credit. I'm emailing the guy right now so we'll see what he says.

I look forward to contributing more on this forum!
