Question Memorial Photo Montage Question - 01-06-2008, 04:50 PM


I've been asked to create a memorial photo montage to be shown at a wake, then, at the actual funeral. Most pictures will be those taken by family members, friends, etc. However, if any were shot by a professional would there be any copyright issues to be aware of?

Yes, if they were shot by a pro, then you'd need a release from the pro to "legally" use the photos. I've created several of these types of collages (I use FotoFusion, by the way). I generally just use the photos that were shot by the family and friends.

I create these all the time and I hardly ever need a realese because you are not duplicationg the image for reprint. You are using the image that the customer already owns to create a video. Now If you give the image file to the client then you are creating a problem. But most photographers would not mind giving you a release for some thing like that if you want to make yourself feel better.
I have used Photo 2 Movie for the Mac and PC, and Proshow gold for the PC only

A) You probably do not need to track down releases.

B) You probably should.

For what it's worth, I would get releases. A few phone calls can be worth gold in establishing good relations with other photogs, whereas cutting corners rarely pays off in the long run.
