If we accept the orders to VA or don't for that matter. I will be in NC for a few months and will be doing some shoots there for friends and such. How the heck do I go about that?
Since I wont be permanently living there, would I still collect taxes for TX or for the state we are going to etc......

i am not a lawyer. you should consult your business lawyer regarding matters such as these.

however, in looking at the faqs from the state sales tax section of the comptroller's website i gather that if you are selling taxable goods to "out of staters" then you do not have to pay sales tax on them, but you need to be able to prove that they were sold out of state. if you sell to entities that will be picking up or receiving in texas, then you must collect sales tax.

again, consult your lawyer. they exist for these types of problems...

i believe you would only be concerned with the laws in the county in which your business resides. you aren't setting up a business from the remote locations, are you?

since the products will be sold out of your home base (i would assume at least) which is in texas the laws in texas are the ones that apply. of course if i'm wrong, which has happened once before, the lawyer you contact will let you know.

That is the thing Once our house sells I will no longer "live nor work" here. And the shoots would be in transit to a new duty station.
I will call jag next week once we know where we are going.

You have to pay sales tax in what ever city you collect the funds. If I am selling on the street and today I am in Houston my sales tax goes to that city if tomorrow I am in Dallas then my sales tax is going to the Dallas tax office. Thats how it works. BY LAW you pay taxes in the city that the sale takes place at.

But If I were you....Just pay them to you the city you regularly do and don't tell any one that money exchanged hands outside of your business address. It is a huge pain to break apart sales and sales taxes between cities. If you were doing over 10k then I would but not for less.

I actually got my answer.
NC I won't have to worry about and neither with VA unless I make a very large amount of money and since we don't know when I will be there I highly doubt that will happen.

Adam, it changed this year. You only pay city tax to the city you are operating in.
