liability vs. malpractice - 02-20-2008, 05:58 PM

I'm signing up and need to know what's the difference or are they the same?? (Through PPA) It seems there is a huge price difference..one is 1000 - 1500 per year and the other $50 per incident. Did I look at it right/?

Liability is more for accidental things(knocking a light over and causing a fire unintentionally). Malpractice is coverage for gross malfeasance, or intentionally damaging someone under the guise of your professional duties.

Think of malpractice insurance as insurance for your professional errors and omissions. It covers professional negligence, such as doctors removing the wrong lung, lawyers missing a deadline, or a photographer hitting the "delete all" button at the wrong time.

Malpractice and liability insurance will not cover intentional conduct of any kind under most policies.

If you go for the malpractice policy, make sure it covers claims brought under the Deceptive Trade Practices Act ("DTPA"). Some policies exclude those types of claims, but if you are selling goods or services to the public that is coverage you will want if you are paying for the policy anyway.

I guess I should have clarified when I first posted. Intention could be interpreted by the client(i.e. you have a bridezilla with many conflicts and subsequent "delete all" situation and she believes that you did it intentionally, that could be a malpractice claim) Sorry if I wasn't clearer earlier. I do some Inland insurance, and we offer that coverage on some of our policies.
