I just called a call from HER (leaving names out) - (hopefully I have the story she told me right)

She was at her companies open house, she happen to have her camera for her personal use and for the "group" she works with. She was approached by somebody asking if she could take pix of such and such and that she needs to give them to the company to use. She was told they hired somebody to do coverage later on in the week but they want her pix from today.

She said she would let them use them if they signed a release, but the lady said she was on company time, so she prob didnt need one. But the way I see it is she wont be on company time when she has to PP them and such.

I hope what I posted makes sense and that i got all the facts right. I just want to see how some of you would handle this.

I usually read very carefully and you confused me.

My question is whether she is paid by the company to be a photographer, or simply to take snaps and send to them? What is her job description? If they are capitalizing on her personal abilities that she isn't normally paid for; then this is a totally different issue and should be handled via a contract, etc....

If her job duties include this type of photography, then I would expect the company would allow her time on the clock to PP the photos and turn them over.

She was not paid by the company to do photos, and photos are not part of her job description.

If it were me I would just take the picture and be done with it. There is a phrase at the end of my job description (and in most of my co-workers) "other duties as defined by management." If course your friend could stand her ground but she is just making herself a nail and there always seems to be someone at work who plays the hammer

If she is a competent photographer and that is why she was asked to take photos by her company (because they know this), then I would say she needs to address this as a separate business arrangement.

If she believes that if she is dealing with people the would be retaliatory concerning her addressing this as a business matter, she is probably working for the wrong people in the first place (I am addressing Larry's comment by saying this).

She should be professional in all circumstances and be ready with a contract and pricing structure before addressing with her boss, etc....
