I was in Phoenix this weekend to cover the Daytona Prototype race for Gainsco Insurance.
It seems the track used my shot to advertise the race. Note the really bad PS on the front end of the car . Since I am under contract, most rights to the photos belong to the client.
I understand this ad is also seen on numerous bus stop benches in town....

What are the terms of the contract you signed? If the client is the Insurance Company, then the use of your photos by the racetrack itself could be distinctly different than the insurance folks using them.

I think it's great they used your photo, but it really gets under my skin to see photog's rights being abused. It's hard enough to make it in this business as it is...

When I shoot for the client, the photos become their exclusive property except I still retain personal rights to use all the photos for my own benefit. The client also deals with "model release" issues. I do not charge a "per photo" fee, etc. i.e. for this shoot I flew to PHoenix, rented a pontiac grand prix, stayed at the Arizona Biltmore, had full media credentials. The client pays ALL expenses, plus my rather substantial fees. I won't divulge the amounts, but this is very lucrative to me since I know exactly what I will be making, and the client has a portfolio of photos they can use any way they like without worry of having to renegotiate with the photographer.
Besides, I have a great time.......

I have other deals with other clients, and prefer to customize according to needs (both theirs and mine).

p.s. I certainly was not upset because my shot had been used on a billboard. I was only a little miffed because they had done such a shoddy PS job.

How cool is that?? Nice! Must have been cool to just be driving along and see it there. Still would be reallly awesome to have a picture I took be up on a billboard.
