The Japanese Garden is a separate entity from the Fort Worth Botanic Garden and has it's own rules and fees. Tripods are Ok in most of the other Gardens but if you are shooting commercially you have to have a permit.

Dallas has different rules, but "Life's too short to live in Dallas".

At the Japanese gardens no tripods are allowed for private shooting, but the $75 fee does allow you to use it. Although, at 9am, there isn't anyone watching. I didn't cheat but I saw someone with a P&S out there when I was ready to leave with a tripod (not sure why for what he was shooting for) but he got away with it fine. I wanted to tell on him since I was pissed I couldn't get some shots I wanted that needed it, but eh. I'm just not that way.

What's their big "concern issue" with tripods for the hardcore hobbyists?

An eyesore/nuisance to others, concern of the tripod legs ruining the grounds, etc?

It is all small walkways, so really, it would be a bit of a pain if there were tripods all over the way and dangerous for the little ones if they tripped and landed in one of the pools.
