There is no requirement of this affidavit. The seller cannot knowingly sell to someone who is ineligible, but nothing as defined as an affidavit is specified.

USPS customer service says only a manufacturer or dealer can ship and that form PS form 1508 must be presented at the time of shippment.

Seems to be a grey area.

I do believe you're commiting a Federal felony by not declaring what you're shipping. If I understand correctly, only an FFl can ship a pistol via USPS and must present the forms upon shipping.

The gun still has to go through an FFL if it's moving across state lines. Transfer within a state has to comply with state law as well as the federal requirement that the recipient complete an affidavit of eligibility which the sender must have in his possession prior to shipping.
1. I had no idea it was illegal.
2. an FFL dealer told me it was ok to ship that way, as long as the gun was disassembled.
3. I still have never had any problems with it.

You have listed on gunbroker. OK.

1. The Buyer's local FFL may not accept from individuals. In which case, you will need to ship through your FFL.

2. Handguns are to go fed-ex overnight. Only. No UPS, no Post Office.

My advice to you:

Use an FFL to ship.

either add the extra cost, or eat the extra cost.

Do NOT take a chance breaking the law over an extra 25 or 30 dollars.

PS I hope you also know that shipping/selling to a person in California, New York and ??
is a real can of legal worms, so make sure your'e gun Ad says NO Sales/Shipping to those states.
(look at other ad's you will see that)

Yeah, but the fees that gunsamerica (not gunbroker) charges are (probably) less than consignment.
