Has anyone ever sold a handgun in Texas? I have a Glock 27 (.40 S&W) that I'm thinking about selling, I'm just not sure the best way to go about it.

A far as I know you are free to sell it any way you wish although I have always made a copy of the buyers ID.

In Texas you need to use an FFL dealer with regards to handguns now. Makes it safer this way now.

Sell it like you would a camera.......I do it all the time. Keep a record of transaction with all the pertinent serial numbers, make, model blah blah.... in case of some weird future incident it may be involved in later down the road. Use common sense, CYA and pocket the money for a new piece of glass.
Not sure about what Doc says. You do need to go through FFL if mailing it somewhere but otherwise...myself and everyone I know just sell'm back and forth...been doing it forever....go to a gunshow and its the same thing. I have friends who have sold their guns in the parking lot before they even get in the building - although changes are on the horizon.

I've sold over 14,000 so I have a little knowledge...Generally, you must follow the same rules as a licensed dealer in that you cannot sell to someone you know is a felon or under indictment or information as a felon...You can't sell a handgun to anyone under 21 or who is not a resident of Texas (assuming the sale is made in Texas)...You cannot sell to a foreign citizen (foreigners can buy from a licensed dealer under certain conditions)...You cannot sell to anyone who has been convicted or is under investigation for the misdemeanor crime of domestic violence...You cannot sell to someone who has been adjudicated as mentally incompetent...

Post it out on texasguntrader.com or texashuntingforum.com - both are good sites with lots of traffic. All you need to see is an ID to verify over 21 & Texas resident. Law says you cannot "knowingly" sell to felon or any not capable of purchasing. Your best bet is to deal with a CHL holder, but it's not required.

What if he's a Class 3 SOT dealer?

(Thinking specifically of Bill Davison at TacPro, who, IIRC, may actually get to become a US citizen around the time his US-born daughter can vote. Nope, private party sales are still legal in Texas. You may prefer to use an FFL, but it is not required unless selling to someone in another state (and then the buyer needs an FFL, not the seller).

+1 on preferring a CHL holder... strictly for peace of mind.

You are free to sell it to any resident of Texas unless you know that they are a felon. That is the only legal requirement. You do not have to keep a record or do anything else. You do not have to go through a dealer. You can take out a free ad on the following site and sell it yourself legally.

A licensed dealer can buy from anyone legally entitled to own a gun...There are plenty of non-US citizens with FFL's...The original post concerns a non-licensee......Ben
