Absolutely inexcusable, even if they end up blaming it on over-ambitious lawyers. I certainly wouldn't use this service until they change the TOS, this one is worse that a lot of those "rights grab photo contests".

Wow, thanks for posting this. What are they thinking?!?!

I was actually just picking out some stuff I wanted to have printed there. I've been wanting to try out the metallic prints.

I guess I'll skip that now. Too bad.

Really? I didn't get that impression from looking at their website. The wording us under the Website Terms of Service. I didn't see where it limits it to the pro account.

Anyway if that's so, it almost makes it worse IMHO.

Simply amazing!

I had assumed, (yes, I know what that does), that dealing with professionals that there would be an understanding of the importance of copyright protection. Has miller's changed theirs recently, or was it like that when i signed up a few months ago without looking at the TOS?

not sure, but its almost verbatim b/t MPIX Pro and Millers. Millers owns MPIX.

You hereby grant Miller's, our affiliates, and our partners a worldwide, irrevocable, royalty-free, nonexclusive, sublicensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute, and publish Your Content and subsequent versions of Your Content for the purposes of (i) displaying Your Content on our Site, (ii) distributing Your Content, either electronically or via other media, to users seeking to download or otherwise acquire it, and/or (iii) storing Your Content in a remote database accessible by end users, for a charge. This license shall apply to the distribution and the storage of Your Content in any form, medium, or technology now known or later developed.

doesnt look like it. im willing to say im confused. i went to look for terms on a couple other labs sites to see if they say the same thing.

If you got to the link that HotHolly posted and click on the subsequent link in there for Terms of Service for Photographers, you will find the following:

License and Ownership of Work Product. Miller's shall not gain any ownership interest in the Photographer's images, except that the Photographer grants Miller's a non-exclusive, royalty-free, worldwide, perpetual license, with the right to reproduce, distribute, transmit, and publicly display any materials and other information that Photographer submits to the Site (the "Submitted Materials") for the purposes of (i) display in the Photographer's albums or galleries on the Site and (ii) production of personalized photo finished products or reprints ordered by Photographer and Photographer's customers, members, or their guests. Miller's disclaims ownership of Submitted Materials. Millers' license to such images will terminate when Photographer removes the images from Photographer's album or gallery.

Doesn't really matter. Both are owned by the same parent company, Miller's. They still need to fix it, which they are currently doing.

basically they need rights to print your pics FOR YOU and display your prints in YOUR GALLERY.
