Who here will knowingly trespass for the shot you want? - 09-27-2009, 09:48 PM

I've been trying to get some motivation for shooting something other than my daughters and dog and have been thinking of an austin skylight view I know of. There is a very cool view of the city that you hardly ever see because to get to it you have to crawl under somebodies fence to get to it... I used to take girls there when I was in high school because it was such a cool view of the city. I now it's illegal, and I know I would probably come outside with my shot gun if I saw somebody sneaking into my yard, but the I still really want the shot. Years ago I asked the people living there if they minded me going back there and they answered by threatening to call the cops... I know it sounds pretty stupid to still want to try it, but damnit, I want the shot. Would any of you risk it for a unique shot?

Why not ask permission from the property owner? If the shot is worth it, jump through a few hoops to get it, but don't put yourself at risk if it's avoidable.

So you asked and they said "no" and you have told us how you would feel about trespassers and now you want to see if others think it's ok? No, it's not ok. Find another angle...

I am sure you will get some that will do "anything for the shot" but I think you should respect the property owners rights, just as you would hope others would respect yours. Pretty simple...

Also, how many years has it been? Owners change and/or people mellow. +1 on trying again.

I never asked if anybody thought it was okay to do. I know it's not okay. I was wondering if anybody here would let their drive get the better of them and take the shot anyways. FYI: The spot I want to shoot at is NOT on their property, but the only other way to get to it is a couple of 30 ft. steep climbs, with the last climb 20 ft. of vertical concrete.

So this place you feel the need to shoot from is completely surrounded by these folks property?

If I couldn't get permission to be on their private property I would not trespass. It wouldn't surprise me if someone has already done this and possibly caused some damage or just left trash on the property and this is the kind of thing that ruins it for people that have good intentions where the owners might of been more receptive.

Just my opinion but it's a fact that not so many years ago you could get permission to access someone's property but people took advantage and you are lucky now days if you can get permission. You might have better luck seeking a period of time to lease part of the land.

There are so many angles to shoot downtown from, just find another one. Drive out around Westlake Hills and you will find more great downtown vistas than you could dream of.

For anyone even thinking about this read:

To me there is a difference between not-asking-and-taking-a-chance, and asking-and-being-told-no. I believe that's also the sticking point that turns "walking on someone's property" into "trespassing."

According to the link, criminal trespass occurs if you: "had notice that the entry was forbidden; or received notice to depart but failed to do so."

I'm pretty liberal when it comes to stuff like this, but if I get asked to leave, I leave. You've already been told no. I wouldn't do it.

By asking if others would do it you are in essence asking others if they think what you are doing is acceptable, it's just semantics...

No. My ethics and personal moral code are more important than a picture.
