Legality of pictures on-line from a live event? - 10-18-2009, 03:31 PM

Hello. I posted some pictures here and on PicasaWeb. My wife just uploaded one of my video clips.

But is it legal to do this? I had posted the following quote on a sub thread, but that thread has kind of died...and my question was buried...

Does anybody have a thought as to the legality of posting a picture or a video from a concert that had a "no camera policy" in one place...but then a "no pro camera or video camera" policy in another place?

or more specifically, can a video with music that I recorded as live music be posted?

Thanks!

Thanks for the reply.

I was in on the thread where this was HOTLY debated recently regarding the carnival and the kids, etc.

The 3rd link in your post was pretty cut and dry...if you can see if, you can photograph it. But, it is still a gray area.

I guess the reason I am questioning this is:

1) Private property - again, the 3rd link above spells it out. But, even though it was a law, it says on the back of the ticket, no cameras, no recording equipment. There was an updated sheet specific to U2 that clarified no PROFESSIONAL camera (lenses not to exceed 3"). So, if taking pictures, I would be guilty of trespassing (breaking their no photo rules). But I am not trespassing right now, so could they (specifically YouTube) pull the content? Or, could U2 legal give me grief?

2) Publishing, but just on a web site, like TPF...not for money (no Google Ad Sense). Like with the analogy of the bridges in New York. Shooting it is prohibited, especially where it is post to not stand there taking pictures. But what if you have a photo that you did take, but no body stopped you. Maybe you got it while you were driving by in a car or from somebody's window. Bottom line, making a video recording was specifically listed out as prohibited. But, non of the security people stopped me. So, is it now illegal to have it?

An analogy for ya:
I drove home drunk once....right past a cop.....nobody stopped me. Was it legal?

But can they come to your house TODAY and say, "Hey, you posted on the net that you were drunk last night, so we are arresting you now". And, the question of legality is not an issue, per the articles, it wasn't like it was a law...only a private property rule.
