Craigslist: Rape - 02-05-2010, 12:07 PM

Craigslist is just a scary....SCARY thing sometime...

Marine arranged ex-girlfriend's rape through Craigslist, prosecutors say - KDVR

Even in the Craigslist "Casual Encounters" section -the red light district of the Internet- it was a shocking offer.

A woman named 'Sara,' looking for a "real aggressive man," asking him to rape her inside her home. Even more shocking, however, was that at least one man, 26-year-old Ty McDowell answered the ad, saying he was willing to be the woman's attacker.

But the biggest surprise was yet to come.

The author of the dark fantasy, police say, was really the woman's ex-boyfriend, a U.S. Marine named Jebidiah Stipe. And it was Stipe, police say, who was e-mailing with McDowell as he planned the break-in and rape.

On Dec. 11th, Ty McDowell broke into the woman's home in Casper, Wyoming, gagged her, tied her up and raped her, according to police.
When investigators from the Natrona County Sheriff's Office sorted everything out, they charged McDowell with sexual assault and Stipe with being an accomplice.

=================================================

I personally think that Stipe should be charged with whatever puts him UNDER the jail for a LONG time and Stipe as the accomplice, or a lower offense.

But talk about a warning for people who frequent craiglist for that kind of stuff.... holy cow...

The Marine should be charged in exactly the same manner as the suspect, since essentially, he too is a suspect.

This just helps lower my opinion of CL even more.

And if this is true, they should be charged equally IMO.

That was also the storyline on a Law & Order a few seasons back. Ex-boyfriend set it up, guy gets arrested doing it, etc.

I think that Stipe is the rapist. He caused the woman to be raped by his own deeds and actions. McDowell was essentially the rape instrument.

I think that McDowell should be charged with a lower level crime (sexual assault, or lower) because of the lack of intent.

Ok... I got you. I thought you were saying it the other way around.

I agree. I didn't want to post that I thought it until someone else did! I do feel kinda bad for McDowell. Sure, he is a little weird to want to do something like this and yes he should have made sure what he was doing was legit, but this is all Stipe. McDowell should definitely be charged with a crime, but IMO the rape charge should go to Stipe.

it's really sad that this guy is going to get charged with (or has already been charged with) rape. Believe it or not, there are a lot of women out there who have "rape fantasies", heck there are entire websites for those sort of people. He really didn't do anything wrong in his mind as he thought he was just helping her live out a sexual fantasy. Instead he's about to get in a lot of trouble. Hopefully at least he'll be able to use the emails from the ex boyfriend as evidence and the jury will see he was at least "mostly" innocent. For lack of a better statement, he got framed.

He may be found innocent when he goes to trial, since he has proof that he was told it was consensual. He thought the woman was in contact with him. The fantasy of playing the rapist is kind of sick, but not illegal if both side agree and are just roll playing.

The DA would be wise to go for a lesser charge, if they want to make sure something sticks. If I were on the jury, I could easily see reasonable doubt in a full-blown rape charge against him.

Now, for Stipe, the ex-boyfriend, I could convict him without a problem. I think accomplice is way too low for this complex plan that he devised. He is the scarier of the two men.

Hell no. Even with somebody with a rape fantasy you would meet them, discuss everything, set up a safe word, even sign something giving consent. Anybody who would use the internet and just take somebodies word without even meeting the person was a rapist already just looking for an excuse. The marines will take care of there own and I hope the legal system buries Ty McDowell so deep cars are flying when he gets out.

I'm not saying this guy should walk, but if you are going to convict people because of stupidity or lack of planning and details, then 90% of the world's population would be behind bars. Just because he was too stupid to meet the woman first doesn't mean he was a real rapist looking for a loophole. He "could" be a law-abiding citizen with a kinky fetish looking for like-minded people who will consent.

He could've set up a safe word through email. He could've been stupid enough to be duped by stipe, and stipe might've typed "I don't want to meet face to face or it will ruin the fantasy." We don't know what manipulation Stipe used. We don't know if McDowell is a very stupid person who is easily duped. The only thing we know is that he is willing to participate in a less-than-positive sexual roll-playing/fantasy scenario.

Stupid people get duped all the time. This one just happened to involve kinky sex.

If any of that was the case the you just don't do it. Stupidity is no defense for breaking the law. A woman was bound, gagged and raped. If somebody is going to play that kind of game they do it right or face the consequences, because the woman who was raped is definitely facing the consequences.

That's why I started my post by saying that I don't think he should get off. Like my earlier post, I suggest that he should be charged with the lesser crime and that Stipe should receive the rape charge. I think he has to answer for this, but he may not have ever had the intent to rape someone... stipe surely did, though. Maybe McDowell gets charged as the accomplice or with a lesser sexual assault charge (assuming it is true and proven that he was tricked by Stipe).
