Scholarly Communications @ Duke Fair use and the law of trespass
Copyright Law Blog: Exclusive Rights Download the 35 court rulling (link in first article) and read- will raise a lot of questions.

Though this is the 11th Circuit I bet the other courts will fall right in behind them soon.

This comes down to having every I dotted and T crossed when dealing with a large corporation for a shoot and then every tom dick and harry involved with the shoot including the guy who sweeps the floor!

I remember reading this case, what a mess...

Good contracts and good copyright registering procedures will help but it is going to be a rough playground...

Well the posts above are the final ruling that just came out from the 11th Circuit Court.
I've skimmed over the 35 page court ruling (link in first article)and it is worth reading if you do any commercial work of any type, will be reading thoroughly later.
