I found one of my images on VYPE Houston - 2010 High School Football Preview. That is awesome but VYPE didn't get permission from me to use. They actually got the image from the Galena Park ISD website.
What should I do with this....I contacted the magazine and no reply just yet.

Have you filed your images with the Copyright office? If not, send them in now. Then contact the PPA if you are a member.

Do you have any agreement/restrictions with the school on how they can use the images? Did you sell them to the ISD or give them to them?

Yeah, I think the first question to ask is "what is your copyright agreement with the school?"

If you gave them unlimited non-exclusive or exclusive rights, they may have given the OK to let this vype publication use the picture.

Yes, All of my photos are registered. I actually uploaded them the same day that I take them so I don't have to keep them around and then forget.

The GPISD don't have a staff photographer but did asked for me to send them in just for posting on the website. There is a caption on every images that says' (C) Juan DeLeon Studio, the GPISD also has my images labeled as "Courtesy of Juan DeLeon".

But if you didn't have a agreement with the school then they may have given it away for Vype to use. The school I cover is private but I do have a copyright agreement with them which clearly says what the can and can not do with the images. It also says they need to notify me when and where an images is used when it comes to publication.

I ran into this same issue with another school district, providing photos to a magazine without my permission...ticked me off royally, because the coach was given express instructions that the photos were for internal use only. The editor, who I contacted, didn't even offer an apology.

Thanks for the support on this issue, but VYPE Magazine and I settle out of court. I'm more then happy with my settlement. What helped me was that I upload all my images to the Library of Congress and gave the magzine my issued number.
