Also copy the FTC on the letter, personally i would copy one of the FTC comissioners. I would also copy the state attorney general (both will likely just send you a form letter unless the collection agency is already under investagation), copy the state AG in TX and what ever state the collection agency is in. PM me if you want principals at the collection agency, i can get them for you

Just an update - I had a meeting about something else with my attorney and I asked about this, showing him the response letter that was sent to the collection agency and their premise that the application obligated my son to the rent. He looked at me loke I was nuts. This was not something he'd heard of and said it doesn't meet the requirements of contract law i.e. that there is an agreement and consideration. The app is an app he said.

Haven't heard back from the collector yet but they still have time to respond to the FDCPA request we made. Although they never sent real evidence of the debt that is required by them w/in 5 days either.

Just to close this out, my son never heard back from the collector, phone, writing or credit report.
