Wow. That restaurant is lucky if it only has to pay out 75,000. That kid could have died.

I don't think it would take much Long Island Ice Tea to build toxic levels of alcohol in a 5 year old kid.

Getting to a 0.30 blood alcohol concentration doesn't take much alcohol when you don't have a very large volume of blood. And at just 0.30 BAC you can have unconsciousness and even a failure to breathe. At 0.50, death is even more likely.

with how much places like that water down their drinks i wonder what his BAC really was.

5 year olds would get a kids cup with a top and a straw, not a regular glass. So there is no way to make a "mistake" about this.

Also, a long island ice tea is usually served in a very large coctail glass, because it will not fit in anything small.
