Buzzblog: Monkey business with a camera sparks copyright debate
I recall a discussion on copyrights before and they went to the person who pushed the shutter, i.e. made the image at that moment in time.
While I agree with that I suppose I would maintain that perhaps an animal can't possess a copyright, but I don't know that. A person can, a company can, these are legal entities. I don't see the monkey that way. But I'm betting this monkey is brighter than many companies I have dealt with in the past. (People too.)
