Looks Like I get to sue somebody BIG TIME- SOB never served me with an eviction notice on some commercial space that I had built out- I will be getting him for construction costs, some items that I had in an office there and some other items along with emotional distress.

I recieved NO NOTICE OF EVICTION AND NOTHING WAS PLACED ON THE OUTSIDE DOOR TO THE BUILDING!!!! He did know my home address because he actually came by my house and talked to me a while back about this and now THIS!

So PM me BECAUSE I AM PISSSSSSSSEDDDDDDDDD!!!!!

By the way I had about 8 months left on a 5 year lease and I have an option to renew-MY REFUSAL!

I'm not sure you will get the emotional distress. Now, why did you get evicted? A lease I used to use fro houses gave me the right to come in and pic EVERYTHING not protected by law up after the 10th. Never had to use it as I always pointed it out. You need to read the lease very close.

It's a full commercial lease-falls under different laws than Residential! HE HAS TO GIVE NOTICE WHICH WAS NOT DONE.

N. Texas courts are notorious for not giving plaintiff's "emotional distress" money.

Since I work in the court system, I think I know a little bit. In Dallas County you are more likely to "get" some money, but you could just about forget it in Denton or Collin county. Most juries just don't give plaintiff's what they usually want.

Thank you, there possibley could be some interesting behind the scenes schenanigans also which would be in my favor.

BTW anyone ever hear of a simple will, done by a lawyer and properly witnessed with no protestations by the heirs taking over 10 months to go through probate?

I would say that ten months to a year is about average even for simple wills. Judges never get in a hurry.

No in Collin County it is 3-4 months and Dallas County top end is 5 months.

I've been the executor on 3 different wills and never saw probate take more than 3 months.

Uncontested simples should be easy, just like an uncontested simple divorce (with no children).
Even in screwed up Harris County probate courts, it's a 3-4 month at the longest wait, unless the executor is dragging their feet (for legal / handling fees perhaps).

The executor is my dad and he wants to get through with this faster than anybody! Lawyer is flabbergasted over what is causing the delays, judge never gave a reason as to why he was pushing this back again and again and now it is supposed to be at the clerks for the last stages and they SCREWED up the paperwork and the Lawyer had to resubmit some forms that my dad had to sign again!
In less than 3 weeks my mom will be gone for a year now.
