Selling Photos of Parades and Other Events - 12-22-2006, 09:24 PM


I had been thinking about shooting parades and advertising photos of the parade available for purchase. But read a response to a question from someone else about this that said you couldn't sell photos of someone I decided against it. Now, I am seeing a lot of newspapers sending out their photographers to photograph parades, pep rallies, school sports, etc and putting them online in galleries. But, they have the option to purchase prints of the photos.

How are they getting by with this? Doesn't the photo lose the "editorial" exemption to be placed online once they put a price tag on it?

They shoot events and allow people to buy prints. You might try contacting her to see what she has to do legally to be able to do this.

Big case that went through the US Supreme Court (Or was it the Supreme Court of NY?) ruled that candid photos of people on a public street are legal to sell for a profit for the photographer and you do not have to have model releases from the people. Now if it is on private property then the wicket gets sticky but out on a public street/square/venue (say a city park or city/state/federal owne amphateater) then you can shoot away and sell.

This was all discussed about 5 to 6 months ago, the case reguarded an hasidic jew whose photo was taken with a remote fired camera on the streets of NY and the photographer had a big show at a gallery I believe in Germany and he also had a book that included the image and the person whose picture was taken said that it infringed on his religious rights if memory serves me right.

It's my understanding that generally a photo of someone shot in a public place can be used and sold as an artistic-type shot, but necessarily to, say, advertise something. But if you're interested in doing this, you'd probably want to check with a lawyer first.
