To actually answer your questiion: In Texas, a person is criminally insane if s/he could not apprehend whether the action was right or wrong at the time it was committed.

There are other times where sanity comes into play in the judicial process. A person may not be sane enough to stand trial (regardless of whether there is an insanity defense). Here, to be sane, the person must understand the nature of the charges and be able to assist in the defense.

And there is also a question of whether a person is competent to be punished. This usually comes up in capital cases. You can't kill someone unless he knows he's going to be killed, and knows that it is punishment for something he did (was found guilty of for those who continue to maintain their innocence).
