It will be interesting to see if the Supreme Court hears the appeal. The way around this ruling, though, will be for photogs to give narrower licenses for their work and to specify that the works sold for newspaper publication (or whatever the first use is) do not include a license for additional commercial distribution in other media, even if it's just republication.
