About a hour ago my friend who is also a home inspector I work with came by to drop of a check at my house. Just as he was pulling up my newley unemployed (layed off from that airplane company Lockeed, spellcheck!) stumbled and fell three times drunk off his &*&% ! Well my friend started to walk over to him and ask whats wrong and I started to quietly yell at my friend to be carefull because he is a very unstable guy! I also knew he likes to play with guns, so I just knew that something was going to happen if he confronted him about his drunkeness. Just as he got to his car window ( yes he was about to drive down a street full of children) he reached around and fumbled for his gun and sure enough he pulled it out and pointed it at him and mumbled something. By then Jerry my friend stumbled backwards and ran towards my front door while my crazy nieghbor was in my front yard yelling. At this point I was totaly freaked and called 911 and then he got in his car and just sat there for a minute. The police were asking me what he was wearing and to describe the gun wich was a 9mm. I only know that from movies! LOL. Then as the police were on the phone he backed out and screamed down the street. I described the direction he was heading and a minute later we heard a crash, sure enough he ran into some poor womans car. She is ok, but he was taken away! I did not go down to the scene, but my friend did and told the police the whole story. They never came back to my house and never called me back, so I assume he is in jail (I hope) I am just a little afraid that they will let him out on bail and he may come over here. I dont quite know what to do ? Should I stay or should I go, like the song says! I think we will be ok, but this guy is wacked. I have always told my wife that he is going to do something dangerous someday! Just a little freaked out and thought I would see what ya'll thought! I don't have any family here because they are in Mass and my wifes family is in Romania!

Say your prayers and trust in God. Then hope your friend will see Him too and get some help. We had a similar neighbor once upon a time who was going through a messy divorce. He ended up on prison, but we moved before he got out (if he ever did). It can be stressful.

Thanks Alton! I know he has had some bad times, but it worrys me all the time about him with those guns over there! Guns & Alcohol, not a good mix. We are saying our prayers though. Thanks again.

Chris, That is so scary! I don't have any advice but I hope some of the officers on this forum will have some helpful info for you. Maybe someone can at least call you when he gets out so you can be watching out? I just don't know what the "system" would have to offer for your protection. It might be worth a call to the police to just ask if there is anything they can do. I know that they will sometimes add additional patrols in an area where there might be a situation like this.

I will be thinking about you and your wife and hoping this all turns out okay for you.

Thanks Patti! I think the reason they never called or came by was because they might have enough info from my friend. At least I hope. I am thinking he was so wasted he may not remember that I was there. I do think I am going to call in a little while to see if they can let me know if he is out on bail. Thanks again!

he was probably so drunk, he wont remember your altercation, and assume the police were called because of the accident.
my mom is an alcoholic, and never remembers conversations or seeing me when she is that drunk.

He won't have that particular gun around, it will cost more than it's worth in legal fees to get it back.

Rusty! Keller, I just inspected a house last month there and when I was done the realtor told me that it was the home that the husband killed his wife in!

Well, just go buy a gun and enact the Castle Law that just went into affect yesterday I believe. (http://en.wikipedia.org/wiki/Castle_Doctrine) If he comes in your home unwanted, put a bullet in him.

I know, that was harsh, but that it what I would do, especially if you know he is unstable. If you feel like he is going to do something just be prepared, don't count on protection from the police, they will not baby sit you home.

Chris,

Do you own a gun? Not that I am an advocate of keeping guns around kids, in this case...I would want to be sure I at least had a fair fight if it came to that.

Of course, I am just spouting off.. My wife would be very upset with that advice.

EDIT: John beat me to it..

Then again.. if you go this route, be sure you are comfortable with how to use the weapon...As they'll teach you...don't point it at anything you do not intend to kill. People get themselves into trouble when they don't know what they are doing or arbortrarily point a gun as a threat...

Forget the gun...a good can of bear spray is $40 and he can still go home to his wife and kids after being treated/dried out/let out of jail. However, it is a problem to use it indoors.

Have you checked on a restraining order?

My friend, Texas has already had better home owner laws than that on the books for years.

tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.


§ 9.43. PROTECTION OF THIRD PERSON'S PROPERTY. A person
is justified in using force or deadly force against another to
protect land or tangible, movable property of a third person if,
under the circumstances as he reasonably believes them to be, the
actor would be justified under Section 9.41 or 9.42 in using force
or deadly force to protect his own land or property and:
(1) the actor reasonably believes the unlawful
interference constitutes attempted or consummated theft of or
criminal mischief to the tangible, movable property; or
(2) the actor reasonably believes that:
(A) the third person has requested his protection
of the land or property;
(B) he has a legal duty to protect the third
person's land or property; or
(C) the third person whose land or property he
uses force or deadly force to protect is the actor's spouse, parent,
or child, resides with the actor, or is under the actor's care.

Thanks guys! I only have a pellet gun, but I am pretty good with it. lol. Seriosly I do have a couple big hard poles next to the door right now! I am thinking he is not that stupid, i hope. He was real drunk and I actualy never talk to the police at the scene down the street, just on the phone! I only hope he stays locked up enough to sober up. My wife is more scared than I am right now. I tried to call the NRH PD allready and had to go through all these stupid options and just hung up! I am keeping a good eye on his driveway and we have a exit plan if needed. I will keep you posted, thanks people its good to have you out there!
