Flickr users... Have you read your rights? - 09-21-2007, 03:26 AM

Hey guys, just check and make sure you know what the usage rights for your photos are when posted to Flickr or via Picassa, whatever. Here's one example:

http://www.foxnews.com/story/0,2933,297545,00.html

There's some info worth mentioning here: http://photobusinessforum.blogspot.c...to-search.html

There's a lot of fine print that goes into using a "free" site to host your images. Make sure you haven't agreeg to let them use them willy-nilly.....

Flickr allows you to set different licensing agreements on your photos and the person in that first story set the license to share their photo. Virgin did not follow it however which is the bigger part of the story.

Virgin did follow it, what they didn't do was get a model release for the girl in the image, not the same thing by a long shot.

I've never had a flickr account until today (local photog group only reason)

What License should I use? Or should I leave it as it is. It defaulted to "none" since I restricted who can download my photos. When I do their lil wizard - it says I should choose "Creative Commons Attribution-Noncommercial-No Derivative" But I have no clue what that means....

from my settings page:
Quote:
Select a default license

This will apply to all photos you upload.

None (All rights reserved)

--------------------------------------------------------------------------------

Attribution-NonCommercial-ShareAlike Creative Commons
Attribution-NonCommercial Creative Commons
Attribution-NonCommercial-NoDerivs Creative Commons
Attribution Creative Commons
Attribution-ShareAlike Creative Commons
Attribution-NoDerivs Creative Commons

You've previously chosen to restrict who can download your photos. Selecting a Creative Commons license here will override that setting on future uploads.

Ahh, I see what you are saying, but they also did not credit the photographer which was part of his license agreement. They just messed up all around.

it seems pretty cut and dried. Nobody has a model release. They have no rights to use the image.

Really it seems the photographer should be the one getting screwed over, but he doesn't have the deep pockets. Virgin should no doubt have confirmed releases as well as copyright licenses though.

I'm concerned that they should have considered getting someone out of law school to represent them though. If he cant even quote his client correctly, I suspect he faces an up hill battle.
