That said....
In the state of TX when you sell a vehicle or motorcycle, do you go to the courthouse or DMV so that both parties can sign the title?
I ask this cause dh just went in the safe deposit box and can't find any of the titles We know they are around somewhere but no clue where as we just saw them last month before we put the house on the market.
The guy is coming to pay and pick up the bike today and we want to know if we have a few days left to find it or not lol.
I am sure if we cant' find it that we can file for a lost and then he just files for a new one right?

I believe just DMV, however you can sign the title over, both of you don't have to go to DMV. Just make sure you date it cuz they have a few days to transfer the title before they get charged penalities. Also have them sign a bill of sale.

Whenever we've sold a vehicle, we've just signed over the title to the people and let them go to the county and have it changed. We send a notification to the county that we've sold it so we aren't liable for keeping it registered and then have proof that it's no longer ours if the new owner starts running red lights or knocking over liquor stores.

You can get a new title at a regional office, it cost $5.45, but you get it immediately.

Make certain you have them sign a bill of sale, it helps to release you from liability for the vehicle. It's best to transfer title at the tax office. If you sign the title over & let them do the transfer on thier own, check on te transfer later. Toll roads, parking tickets, bank robbery? They all would be tracked back the owner of the vehicle... YOU!

Thanks all. We have never had to do a bill or sale lol.
Guess we better get it all done cause they are on the way with cash.
Now if we can just find the blame title.
Should we have a witness present for the bill of sale signing?

You better check, because I think you will also need to sign the title tranfer document that states how much was paid for the bike and a mileage statement of actual mileage.

Your best bet is to go to the DMV with the buyer for all the reasons already stated, plus they will have the document that Darrell mentions. If you don't give him that form, he will be back to see you to get one filled out and signed.

If you don't have a bill of sale form, I would hand write one describing the sale, date, place, buyer and seller, and both sign it. I've had to use a copy of just such a document to avoid a parking ticket issued to a car I had sold.

I would not buy your vehicle if you could not produce the title. If you can't find it, you will probably be looking at delaying the sale until you get a valid copy. If your buyer takes the vehicle without getting the title, that's between you and he, but it's actually in your interest for him to go to DMV and register the sale, and he can't do that without the title.

I found the title woohoo. That is one less stress lol.
DH wrote up a bill of sale, with VIN#, make, model etc....
We will call and make sure all is taken care of.
They paid yesterday and picking it up tomorrow.

the old plates? Leave them on the car so they can drive it off and be legal. The are responsible for switching plates when they register. This is where the bill of sale is yo evidence that the car was sold on said date.

In Texas, plates go with the vehicle, unless they are handicap, vanity, etc.

the buyer lives in Kleburg Co
But he is going to register it in S. Dakota which Tax office do we send everything to?

we sold my wife's car a few months back as she got a new one...signed over the title and there's something on the registration website where you can enter the information to show you've sold it, you need some info from the buyer though.
