Or maybe not. I don't know..

but this website of a photog based here in colorado - once again, I love my copyrights - I don't appreciate my stuff being used without proper credit etc etc.

I wonder what the plain white t's would think of this...

No doubt royalties have NOT been paid for this..... It may have, but I don't think so.

Any opinions?

I doubt it also.

When thinking about my site I had this very issue in mind. So I am getting my cousin who is getting his masters at UNT in music to compose so music for me.

Personally, I would say having that particular song would do enough to detract customers from their site, that they'll get what they deserve by breaking the copyrights in that regard.

I say this mainly because I detest the song.. not because its a bad song, but because radios nationwide have overplayed it more than most any other song I've heard on the radio the past 6 months. Thus, having it as the song when first arriving to the page, automatically makes me think to myself "Hmm.. this is very cliche, I dont want a conformist photographer, I want someone who sets themselves apart"

Hmm.. sorry, that was more a rant about conformists than the copyright issue. But you bring a very valid point, Lisa. It is pretty hypocritical for a photographer to use copyrighted music without approval on a business website.. people forget its not like myspace where to put music on your page, you get it from myspace, who has paid royalties to all the music available from them.

music on websites is cheesy... IMHO...

Does it have anything to do with the fact that the photog is using that music to sell their work? Most kids on MySpace aren't trying to sell something like their photo skills. I haven't a clue as to what the laws say, but my guess would be it's a bigger no no to break copyright when used to make money off it. vs. being used in a blog.

Well, as kind of mentioned in my post, you can't just put any music on your myspace, it comes specifically from myspace's "myspace music" portion of the website, and it is only songs/artists they have arrangements with, is my understanding.

Course... since when has my understanding meant much to anyone? lol

Oh and I completely agree to the cheese factor of music on websites- nothing turns me off more and makes me click away than hearing some music when I click on a non music related link. You expect it when you are going to www.rush.com but not when you go to www.thewoodlands.com (hate it with a passion).

Oh, so the "plain White T's are a band? I saw this post this morning, but as soon as I clicked to open the site and the loud music came on, I was outta there. I didn't respond because I didn't stay on the site long enough to find out what you were talking about. So unless someone really likes that song, they are probably driving people away.

They actually have MySpace players that where songs that artists have allowed to be used can be posted on that persons page. I don't know the legalities of it, but I am sure it is benefiting the artists.

It is almost as big as Napster was, so the artists are definitely aware it is happening or we would have already heard them screaming.
