Abel, spend the $150 on Fotoquote Pro.... You will find that it will back up a price of likely thousands of dollars. Great quoting software and has a large amount of scenarios and usage rates.

Also, are you a PPA member? If so, just give them a call, their legal department can give you some advice that is based in fact instead of just a bunch of us with good intentions and dubious legal knowledge...

Don't know that I would be able to give you any solid advice on this. What I can do, is talk to my brother. He is an Intellectual Property Attorney. All he does is fight cases like this and anything to do with Trademark, copyright and intellectual property. He can probably tell you what your best course of action would be.

At any rate, you going to have to have a good idea of what your image(s) is worth. Depends upon whether or not the company that stole them is willilng to deal or willing to risk you taking them to court.

without getting to deep if you don't want to reveal all the details just yet Abel, can you give us an idea of what the company does or something, at the least we could all refuse to support said company. Sometimes the actions of consumers speak loudly as well.

without going into too much detail right now...

its a company that you probably wouldnt deal with... i dealt with them on another venture a few months ago and our arrangement had been finalized. they themselves took the web size photos i shot back then and used them for their print ad this month.

they had even asked (back then) if they could be used for an ad and I told them absolutely not without future compensation. they even wanted to buy 10 - 20x30s from me but balked at the price of $150 each. I guess they thought that was too expensive when in fact its actually VERY VERY cheap.

We shall see..

Sounds like you have all of your ducks in a row (i.e. written usage agreement), which means if this company exceeded the usage agreement, that's a breach of contract

Only advice I can give is that if you state a compensation price in your letter, you are in effect establish the top value for your image use. So...use a good figure.

Good luck, buddy.

PPA is well worth it just for this.
