Question about "Taking" pictures - 05-12-2008, 11:44 AM

And by "taking" I mean "right click" "save as" and then uploading the image to a personal hosting site.

Recently I stumbled across one of my images in another person's article. He saved the file to his computer and uploaded it directly to his site. He has a link back to my site as "credit." But still, how can this be legal?

And if it isn't, how is this different than quoting someone and citing the source?

I'm not too up in arms about it. Mainly because I really just don't care right now. I have way too many things on my plate. But I did entertain the idea of sending him an email. Just an FYI "I know what you did, and you should have asked permission" But didn't want to make assertions that just weren't true.

"What you did was illegal and violated my copyright" You can either ask for my permission to use MY photo, or remove it from your web site and no further action will be taken.

Simply put, giving you credit does not satisfy the legal requirement. The legal requirement is "your permission" to do so. He may use a hyperlink to your site, but not the actual file. Quoting and citing the source is only legal if, again, permission is granted to do so. It rarely is, instead a link is more often used back to the owning site.

Since most folks are unaware of copyright rules, assume it is an innocent error on his part. Start by firmly but politely writing a note to him to remove the image. If that doesn't work, a letter to his hosting site regardling copyright violations would be the next step and is often all it takes.

What (if any) copyright did you assign to the image. If it was published w/o explicit permission to use then what they did was wrong. For the stuff I post online for friends/family I always assign a creative commons license that allows non-commerical use with attribution so that there are no issues with them using the images but I have some protection if they were used by a commercial entity for gain.
