This is the deal
we were supposed to close on the sale of our house today. Obviously not happening.
But this is the issue. First off we were never told nor was it in our contract that it was contingent on the sale of their house.
Well they were "supposed" to close on their house yesterday or today. Not sure if they did/have. Well now THEIR mortgage company is telling everyone they can't have the paperwork done until the middle of July at the soonest.
Well we move into housing on the 7th. They start taking the BAH on Monday! DHs pay hasn't been straight so we don't have enough in savings to cover the entire mortgage that would be late as of the 16th of July, since the allotment for housing will kick in.
They are telling me I am being unreasonable to request that it close by the 3rd.

I am beyond pissed and cutting this short cause I started this thread about 2 hours ago.

I'm not sure about where you are but in Texas, when this happens, usually the buyer closes on the house then the title company sets up a lease arrangement where the seller pays "rent" till they move out.

That far beyond sucks.

Our closing experience was about the same. They upped the amount we needed daily and then said we were 300 short at the table. DW came unglued and I and our realtor kind of moved back like she was going to either explode or turn into the hulk at that moment. Poor poor DR Horton Manager came to let us know that the VP wasn't available and we were SOL. After threats of us camping at the model home and hunting the VP down he magically called the manager onsite. DW, let him know exactly what she thought about the whole process and how we were treated by DRH.

Needless to say, They ate the $300 and we moved in that day. (after papers were drawn 3 different times)

Thanks all the pisser is we have to pay the Navy a fee if we break the lease with them.
I told our realtor these are their options:
We close by the 3rd, no ifs ands or buts!
They rent from US until we close
or they can take the contract and shove it!
No word yet.
They act like because it is a buyers market we will bend over and take everything they dishout. Well they saw the bitch in me today! And dh wasnt' much better. This is complete BS.

Thanks for all of the luck, Hopefully the ones that were interested in renting before the contract still want it, supposed to know tomorrow.

damn Breezy, that is suckie! Hope they get their heads out of their butts soon.

I'm' still trying to talk dh into buying here, I'm tird of paying someone elses mortgage for the last 5 years. I'd rather be paying my own. Not like the Army will ever let us leave here. Hell he got orders to stay here just leave Cav and go to another division and Cav wont even let him leave Cav. Go figure!

right about now I either want to leave or stay here and buy. I hate renting here. Rent keeps going up and BAH is staying the same. go figure.

this is one of the best places to buy in the country and my husband is an idiot for not wanting to buy. I really want to drug him and somehow con him into buying a house. I'm still working the angle.

Do we all have a mortgage story? I know I do. The moral of my story is NEVER use the mortgage broker recommended by the builder. They can F* up a wet dream!

When I bought my latest house, the mortgage agent moved companies. My fault I followed her to the new company rather than staying with the original mortgage company. When the agent rewrote the contract at her new company she got a clause wrong. I did not find out about his until 8AM the day before closing. I called mortgage lady, her assistant, and the builder agent. No one answers their phone. I leave a voice mail stating that if they do not correct the clause that we will not close. Period! I further state to contact me by 3PM and leave my cell number. All day, nothing. 3PM, everyone want to talk to me at once.

Everyone asks how to proceed. I say change the clause or no close. Everything gets faxed and the title company gets the information. 8AM the next day, closing goes flawlessly.

This would not have been so bad, but the mortgage company asked for my financial information three times claiming they did not have them. I hand delivered the last one. When the assistant place the paper work in the folder...right behind the last two copies, I about blew my top.

The mortgage companies forget who the customer is. I can get a loan anywhere and I know it. I don't let mortgage companies push me around.

In your case I think this was an agent issue. The selling Realtor should have informed you of the stipulation. I'm no lawyer, but if they cannot meet the agreed to closing date, that is a breach of contract -- if, as you say, the sale of home stipulation is not in the contract. Put the house back on the market after the contract expires. You are under no obligation to sell to these people unless they renegotiate the contract.
