I believe it has something to do with the Fourth Amendment
I should have added that the gentleman was standing on the shoulder of the road on the tracks with his camera in hand taking photos. He was not in his vehicle at the time. Don't know if this changes the legal ramifications?

This video is geared more to the casual drug user but the basics of it can apply to anyone...It's kind of long at 45 minutes but it's interesting viewing...Ben

Not for a search. Consent, or probable cause. One can be patted down, for wepons, which is not a search and not as detailed. Mostly a touchy feely outside of the clothing.

I'm interested!

OK, seriously, I was not your man on the OP, but I did have the DC thing happen to me, but since I was not shooting "professionaly" I was left alone and did not shoot professionaly, just very well. Now, as for here in the old home town, I was shooting the Frisco nightlife and, er, eh, there's a different story...

You think the police is bad, try taking pictures in downtown houston near the skyscrapers. The security will hunt you down and give you nasty looks. I get hassled all the time. Most cant do anything to you unless you are on their property and at most they can do is ask you to get off. But its still a pain in the butt to get harassed. I understand most are just doing their jobs. And I respect them for that.

Yes. My shot. Come to a gtg sometime if you have further questions. It was all polite, if perhaps a bit tense. No scenes from L&O SVU!
I have been scouting out other bridges with sidewalks that are open to foot traffic... I am not convinced I gave that shot my best. I may even go thru the hoops to get the PD in on the next attempt.
