To the hobbyist shooter, this probably is "Much Ado About Nothing".

But to editorial/commercial photographers, this is going to affect them. Their contacts are going to be re-written, publicist looking over their shoulders (more so then ever) and just make doing the job a bigger pain.

I'm surprised some people don't get that

Mark Turker has a good write up about it.

Mark Turker has a good write up about it.
This guy is almost just as bad with his liberal interjections in what is supposed to be an "objective" article.

No doubt that she has the right to express herself with her images, but most contracts have a clause that says something to the effect that you will do nothing to compromise the reputation of the client (in this case Atlantic Magazine) and specifically lays out what the images can be used for. I haven't seen her contract, but the publisher of the magazine has and he says she has violated her contract and that's why they aren't going to pay her and may sue her. She did produce 1 good image for them to use on the cover, but she apparently violated at least 1 part of the contract. My guess is she will ultimately get paid for the 1 shot and then lose in arbitration for an amount much more than what she made from the shoot.

In the end she will be o.k. financially, because she will lose a lot of main stream clients but will pick up some others with agendas.

What we should all learn from this is that we must be ethical in anything we do and don't go about things with a hidden agenda.

An example is when I covered the Cindy Sheehan protests in Crawford, I took images that worked for both sides and I don't think you would know which group I supported by looking at my images and I think that is always how it should be. We are there to do our job, tell a story, etc. and that's it, whether we are shooting as a photojournalist, editorial photographer or commercial photographer.
