Question about Human Form - 02-20-2009, 11:45 PM


I notice a lot of people posting boudoir and other types of photos up in the Human Form section here. Just curious... Do you guys tell your clients that you are posting them online? It would seem to me that many of the shots I have seen (perhaps) were not intended for others to see.

Just curious.

I have model releases for all my model photos. Per the release, I can use the photos in any legal way that I please. My impression is that most of the photos posted are of models who are modeling. They aren't afraid of having their images published (quite the opposite).

I am talking more specifically about boudoir and/or maternity/birth shots for customer's husbands and the like...

My only experience here is a maternity shoot that involved some implied nudity. She signed full model releases (Getty's) but had some reservations about me using the implied shots online. I told her that I would not and I don't intend to per my word. If ever I was trying to develop an online boudoir port, I would verbally ok this even with a model release, just proper form I think.

I will still show these implied pictures to a client in person, as that was discussed and she was cool with that.

This is a pretty good question.

If I have a TFCD then a model release is signed and the model is aware that the photos will be used by me for promotion.

If it is a paying client, I will first show the images to them and then we will discuss their comfort level in others seeing them. If they aren't comfortable then I don't publish them in any way.
This hinders my advertising effort, but the wishes of the client always prevail.

It is my belief that legally you wouldn't be required to have a release as long as you aren't using them commercially, or you aren't portraying the subject in a way that alters the original intent of the image. Putting them on this forum is not commercial use, but putting them on my business web site would be commercial use. Common sense dictates that you not publish images that would embarass the subject.

what do YOU think ?

I think if you/us/we/them post them here as an example of our work and have a link to your\our websites. Then you/us/we/them are using them for self promotional reasons to bolster our business thus a commercial usage and a release would be required.

I might be asking this question in the wrong forum but I figured this can of worm has already been opened. Having no experience in this realm as of yet but wanting to, how does this work if you are paying the model/one being photographed for your portfolio and/or advertisment? Surely a release is still needed? I got burned by not having a release during my 1st and only TFP shoot 2 years ago. I'd like to get back into this but this time I've been seriously thinking about myself as the client. Just curious. I'd like to read about other members expierencs on this until return home and attend a few workshops.

For clients I always tell them that I may use their photos on the web and for promotion. I tell them that I will show nothing that you can't see at the beach or pool. If I want to use more revealing photos than that I will contact them for their approval before displaying.

If it is a model that I am shooting fine art nudes, they sign a release. I start out with the release and verify age. I am paying them and they already know that I will use those photos for promotion. I would never use a photo that I think will compromise the person being shot or show them in an unflattering way. If it is questionable then I would speak with them.

There are alot of sources for information. I use the personal rule: if in question, get a release. If it is TFP or TFCD I always get a release.
Dan Heller has a book "Guide To Model Releases" and Carolyn Wright also has information in "Photographers Legal guide"

I don't post anything, human form or otherwise, unless I have a signed release that says I can do it.

Good answers.

I was just curious. I think my wife would die if a maternity photo of her was posted anywhere.

I guess the way I look at it... TFP/Trade is exactly for promotion on both sides (yes with release). It's the paying customers that may not be aware of what they are signing and such that concern me. Personally, I never post anything from a client without getting an ok first (along with a release). I don't want there to be any misunderstanding at all...
