No offense, Bryan, but impressions don't count much in court. This issue is not as simple as that, and while my understanding differs, I'm not about to give you legal advice, as I'm not qualified to do so. Just be sure to get legal advice from a qualified source--not doing so is how people lose a lot of money.
Ok who is a qualified source? I've heard lawyers talk about this and contradict one another. I have heard police officers contradict. I have heard OH SO MANY photographers contradict. So just who do we listen to? That is a hard question to answer.

True, but an attorney is generally better qualified to give you legal advice than someone like me. Have you actually visited with attorneys that specialize in this area of law and have them give you radically different opinions on the subject?

At least if a lawyer gives you bad advice, you have some recourse.

Oh, and I love cops, but don't get me started about their knowledge of the law. They often don't know jack.

Also that State Supreme Court ruling was in NY and may not hold spit down here or in other states.
